What Does a DC Trademark Attorney Do?

We don’t just submit a USPTO form. Typical matters include searches and clearance opinions, federal application strategy and filing, Office Action responses, monitoring and maintenance, TTAB opposition and cancellation proceedings, enforcement strategy, and international filing plans.

The goal is commercial: own a brand you can use, register, and defend without an expensive rebrand later.

Search and clearance

A search finds potentially relevant marks. A clearance analysis evaluates whether the proposed mark can reasonably be used and pursued for federal registration. I give you a direct read — proceed, modify, or choose a different mark — before any application is filed.

Federal registration

Registration can provide nationwide constructive notice, a presumption of ownership and exclusive rights as to the registered goods and services, the ® symbol, and a stronger platform for marketplace enforcement. It is not automatic. Owner, identification, class, filing basis, and specimen all have to be right.

Office Actions

Some Office Actions are procedural (identification, specimen). Others are substantive — likelihood of confusion under Section 2(d) or mere descriptiveness under Section 2(e). I explain the issue in plain language and prepare the response when a response is the right next step.

Monitoring, TTAB, enforcement, international

Protection does not end at registration. I help clients maintain filings, evaluate new conflicts, handle opposition and cancellation matters when the fight is worth it, and plan international protection — including Madrid Protocol where it fits. Foreign-domiciled applicants generally must use a U.S.-licensed attorney before the USPTO.
